Big bad JBC in cover-up

No other senior associate justice of the Supreme Court, all of whom were applicants for the post of Chief Justice which seat was vacant due to the Senate having convicted then sitting Chief Justice Renato Corona—got away with not meeting the stiff requirements of the Judicial and Bar Council (JBC)--except then junior Associate Justice Lourdes Sereno.
All the senior SC justices who were deemed applicants for the top post submitted the required 10 years of their Statements of Assets, Liabilities and Networth ( SALNs) and laid bare their bank accounts, foreign and local and none of them were considered by the JBC to the top post.
It was Lourdes Sereno, she who earned a low mark of 4, who should have been disqualified, was listed down by the JBC for submission to the yellow president.
Wow, What special treatment! Even the JBC officials then were clearly covering up for Sereno’s major deficiencies.
It was found out during Monday’s impeachment hearing, that two of the three SALNs Sereno submitted to the JBC were not subscribed under oath, as confirmed by former chief of the JBC Office of the Selection and Nomination Richard Pascual.
The current chief of the JBC office, Atty. Socorro Inting pointed out that the 2009 SALN of Sereno was not declared under oath.
Sereno submitted three SALNs for her application, for the years 2009, 2010 and 2011.
Pascual confirmed Inting’s statement, saying that the 2009 SALN was unsubscribed.
He admitted that the report he had submitted to the JBC, he did not state that the 2009 SALN was unsubscribed.
The 2010 SALN was also unsubscribed.
Pascual admitted that he did not include in the report the fact that the 2009 and 2010 were not subscribed.
How is it possible that the JBC, knowing the facts, allowed Sereno to get away with it, including her baring of all her bank deposits, foreign and local, especially as this comes at a time after CJ Corona’s conviction and the claimed failure to include all his assets and certified copies of his foreign bank account, which was used by the senators to convict Corona, without concrete proof, to the extent of floating the foreign deposit of some $1 million earned through the years of private law practice, and worse, Ombudsman Conchita Carpio Morales, who had an ax to grind against Corona under oath claimed that Corona had 86 bank accounts and that he had $12 million in them, which was a blatant lie. It was perjury too boot.
Some of these JBC officials continued with the cover up job, as its Executive Director Atty. Annaliza Ty-Capacite said the application process was different at that time.
“The executive committee members do not determine yet whether a candidate should be included or excluded because of lack of requirements,” she said, adding that “those lacking requirements will still be interviewed or be given another deadline.”
Capicite also explained that the applicant (Sereno) had “substantially complied” with the requirements for the position despite failure to submit SALNs for a period of time if “there is an attempt to comply.”
Sereno had “substantially complied” and that the process was different this time?
What? The process changed and that an applicant does not have to meet all the requirements and that all that is needed is for the applicant to issue a certification from the applicant that she had “substantially complied” with the requirement, especially following the conviction of Corona on his failure to include certain assets?
One would think that the JBC would have been extra strict in screening all the applicants and insist on all requirements being met.
But no, not for Sereno. She was treated differently. She was so special that even her unsubscribed SALNs were not mentioned in the JBC officer’s report.
Associate Justice Diosdad Peralta said that on July 23, 2012 Sereno wrote to the JBC asking for her exemption from the 10-year SALN submission rule. Peralta said the letter was not presented to the JBC en banc.
Neither were the results of the psychiatric evaluation of Sereno, where she received a low grade of 4 and should have been disqualified, was presented to the JBC en banc.
JBC officers and officials hide from the JBC en banc important documents and information on an applicant who obviously failed to meet the requirements and even falsifies her submitted SALNs for Sereno not to be able to have her SALNs subscribed officially. And we have her at the helm of the High Court?
The way it looks, the JBC was taking orders from then president Noynoy Aquino to ensure that she gets in the list, which is why everything is now being covered up by the JBC officials themselves.
The one thing which is clear: The JBC is not independent and is guilty for covering up for Sereno.
Sereno should be impeached and convicted.

    Itis now very clear that then AJC Sereno was accomodated by the JBC despite of non-compliance of all the requirements on orders of the yellowshit president who eventually appointed her. Therefore, as a Solon prober said during the hearing, her appointment is VOID from the very beginning thus considered as FAKE CJ now wrecking havoc in the Judiciary. For me, she's guilty as charged,but wait..If somebody will come into her succor like Attys Money, Money and many more Money to come up with a 200M bribe each to Senator Judges theres a big possibility that she will be acquitted. If that happens, the Senate will become a damage institution deserve to be abolished, and the RAGING MOB might EXTERMINATE all of them..
