Aegis Juris member files homicide rap vs frat brods

A criminal charge of reckless imprudence resulting in homicide has been filed against members of Aegis Juris Fraternity before the Manila Prosecutor’s Office in connection with the death of University of Sto. Tomas freshman law student Horacio “Atio” Castillo III
In a six-page Complaint Affidavit, Carlos Brian Bangui, himself a member of UST Law Aegis Juris Fraternity, said he filed the case against the 28 frat members and several John Does to clear the image of his brotherhood.
While Bangui said believes there was culpable liability on the part of the respondents, he, however, stressed there was no intention to kill Castillo through welcoming rites.
“The absence of malicious intent does not automatically mean, however, that the accused fraternity members are ultimately devoid of criminal liability,” he said, quoting a Supreme Court decision.
Bangui cited Article 3 of the Revised Penal Code which also punishes felonies that are committed by means of fault, “when the wrongful act results from imprudence, negligence, lack of foresight, or lack of skill.”

“Apparently, the named respondents have been negligent or lacked the necessary precaution for failing to foresee and consider the actual condition of (Horacio) Castillo III during the welcoming rite,” he stated in his complaint-affidavit.
The accused were Arvin A. Balag, Axel Munro Hipe, Marc Ventura, Marcelino Bagtang, Oliver John Audrey Onofre, Ralph Trangia, Joshua Joriel Macabali, Zimon Padro, Leo Lalusis, Mhin Wei Chan, Rannie Santiago, Alex Cairo, Daniel Ragos, Luis Capulong, Zach Abulencia, Karl Matthew Villanueva, Ged Villanueva, Daniel Hans Matthew Rodrigo, Kim Cyril Roque, Edric Pilapil, Jose Miguel Salamat, Robin Ramos, Alex Bose, Ronald Cheng, Sam Cagalingan, Dave Felix, Milfren Alvarado, Chuck Siazar and John Does.
“I am executing this complaint-affidavit to attest to the truthfulness of all the foregoing averments for whatever legal intents and purposes it may serve, more particularly to prosecute the herein named respondents,” he said.
Several respondents named in the complaint are facing separate complaints for murder, robbery and violation of the Anti-Hazing Law.
Rosemarie Trangia, mother of co-respondent Ralph Trangia, is accused of obstruction of justice while John Paul Solano is charged with murder, perjury, obstruction of justice, robbery and violation of the Anti-Hazing Law.
Castillo, who died following initiation rites of the Aegis Juris fraternity on September 17, was laid to rest last September 27

    Today, I went to the beachfront with my kids.
