Dismissed former Makati Mayor Jejomar Erwin “Junjun” Binay Jr. said he has no liability over the case of alleged overpriced construction of the Makati Parking Building.
This was contained in Binay’s 32-page motion, asking the anti-graft court Third Division to reconsider its April 18 ruling finding probable cause against him for charges of graft and falsification of public documents. In its resolution, the anti-graft court said there is probable cause that the alleged crime against Binay were committed and that all elements of falsification and graft are present in his cases.
But in his motion, the young Binay argued that the resolution of the court lacks bases in fact and in law as it unjustly pointed the finger at him as a conspirator in the allegedly rigged bidding process.
Binay and his co-accused were charged for alleged conspiracy to give unwarranted benefits andpreference to Hilmarc’s.
The city government has awarded the contracts for the parking building worth P2.28 billion.
The Ombudsman found probable cause that pave the way for the filing of cases against the accused, the young Binay.
In its resolution, the Ombudsman said the project was implemented through six phases from 2007 to 2013 even if there was no approved design standards, contract plans, agency cost estimates, detailed engineering and programs of work, among others.
Binay though was indicted for the construction of the parking buildings Phases IV and V.
In his motion, the dismissed mayor said the court erred in finding probable cause against him for falsification of public documents and reiterated that he had no role in the alleged falsification of Affidavits of Publication for the project, and pointed out that these documents can be falsified even without his participation.
According to the motion, the court also erred in finding probable cause against him for graft, as there is no evidence that would show that he caused undue injury to the city government of Makati.
It further stated that the phases of the parking building had been completed by the contractor, and now houses numerous offices by the city of Makati.
