Impeachment case to be expected on the new CJ

It may not take long before an impeachment case will be filed against the new Chief Justice (CJ). With the morons at the Palace beside the Pasig River expressing disastisfaction over the choice of the shortlist from the Judicial and Bar Council(JBC), it would mean that the new Chief Justice who will be appointed soon by BS Aquino will certainly not be to his liking and that his appointment of the latter will only  be through sheer force imposed by the Constitution.
It is a pity that the country had to go through a very emotional and tedious impeachment trial and conviction of CJ Corona, only to find out that the President who was responsible for the ouster of Corona is not pleased with the selected nominees despite the careful and thorough selection process under the watchful eyes of the entire nation. Whaah!, what kind of government is this?
In an interview, BS Aquino said, “personally, I am not satisfied with the choices made by the JBC.  The way I see it, the rules on disqualification were not applied equally. There were nominees who had disbarment cases (but were not disqualified). In the rules of the JBC, when one has a disbarment case, that nominee cannot be considered. Then the rules applied were suddenly treated differently. There were those who had cases who were suddenly absolved. There were also others who really had no case against them, yet they got immediately disqualified. How can that be a fair process?, BS Aquino asked.
After packing the JBC with his men like Deputy Secretary Federick Musngi and the reinstated House member Niel Tupas Jr. and Sen. Francis Escudero, is it not moronic to make those statements or ask those questions considering that he had  the total control of the JBC. Musngi alone who was illegally designated to replace De Lima in the JBC can veto every nominee to be included in the shortlist, so why did Musngi allow the inclusions of these names that will cause dissatisfaction for BS Aquino. Wasn’t he told that by including Zamora, Brion, Abad, Villanueva and Jardeleza, President BS will not approve their  selection and inclusion in  the shortlist?
It is a terrible insult to these luminaries who were included in the shortlist for BS Aquino to say that he is not satisfied with them and that they do not deserve to be Chief Justice of the land. It would appear that these people do not reach his standard of capabilities and wisdom. I wonder what sort of standard BS Aquino has to say he was not satisfied? Or is it that, his standard of satisfaction lies in the idea that the ones chosen in the shortlist are those people he can dictate his wishes, such that he was dissatisfied with the choice of Zamora, Brion, Abad Villanueva and Jardeleza because they are independent minded and strong willed, hence, he cannot  dictate on them to do this and do that.
Definitely, the legal minds, experience, capabilities of those in the shortlist are far superior than the one who said he was not satisfied with them. Their credentials alone  speak for themselves. Most, if not all of them are bar topnotchers in the higher bracket. I can speak surely of my  good friend Ronaldo “Ronnie” Zamora whom I admire as a man of integrity, probity and integrity. He had the courage to face the powerful when we were together in the opposition then. Ronnie was number 1 in the bar exams and the top of his graduating  class. He was executive secretary of former President Estrada and was the youngest executive secretary of President Marcos. He was minority leader of the House of Representatives in several congresses and I was with him in denouncing the election cheating in the 2004 elections where Garci figured prominently. I remember Ronnie, myself and several opposition congressmen, while we were denouncing on the floor  the Garci tapes, another congressman who is now so powerful and has expressed dissatisfaction over the shortlist of CJ candidates was busy defending Macapagal Arroyo and Garcillano then.
Why would someone be dissatisfied with Justice Arturo Brion. Brion is a brilliant lawyer and bar topnotcher. Although he was the Secretary of Labor in GMA’s administration, he was doing a good job and was promoting the welfare of the labor sector such that nothing was heard of Brion having a graft and corruption cases being filed against him. There are no indications that as Associate Justice of the Supreme Court (SC), litigants are complaining of his decisions being unjust and erroneous. He may be appointed by GMA as Associate Justice of the SC, but he had been deciding cases purely based on facts, law and evidence, hence he deserves to be Chief Justice. Just like Brion, Roberto Abad is equally deserving. Except of his  being identified as a prodigy of Estelito Mendoza, Justice Abad has all the credentials of becoming CJ. He was Dean of the University of Santo Tomas, College of Law and a many years as asistant solicitor general such that he a good grasp of the practice of law.
Just like Abad, Francis Jardeleza is also deserving of becoming CJ. He may have worked with San Miguel Corp. and some are saying he worked with Danding Cojuangco, but having personally followed his legal career, Jardeleza is a pretty independent and competent lawyer. I admire his independence when he became solicitor general and immediately took the cudgels for the government to collect from Shell Pilipinas its tax liabilities. The tax liabilities emanated from  Shell’s alleged engagement in smuggling activities through the underdeclaration of its products which arrived at the port of Batangas. Jardeleza did not heed the call of DoE officials notably Secretary Almendras to go slow on Shell.
As for Sereno and Carpio, BS Aquino may be right in his dissastisfaction with the JBC. Whether Carpio is deserving of the Chief Justice position, I encourage our people to read the disbarment complaint of Lauro Vizconde  and Magdaleno Peña. For Sereno, ask the Luisita farmers if she deserves to be at the helm of the SC.
It’s a pity though, that having noted the outstanding credentials of most nominees included in the shortlist, BS Aquino has still the temerity to be not satisfied and despite that, he is still mandated to appoint one of them as provided by the constitution, Since he has doubts of his new appointee, especially when he has the tendency to dictate and gets what he wants, and the appointee may not follow him, he will again resort to impeaching the new CJ. After all, he has congressmen in his sleeves and pockets and by just one stroke of his finger, voila!, impeached and convict the disobedient CJ.
