NBI arrests Pinoy wanted in Australia for rape of cousin
11/21/2009 The National Bureau of Investigation (NBI) has arrested a Filipino who was facing an extradition case in Australia for allegedly raping and molesting his teenage cousin during a manuhunt operation in Novaliches, Quezon City. Reports reaching the office of NBI Director Nestor Mantaring said the suspect was identified as Gary Zabat-Guban. He was arrested by virtue of a warrant of arrest for extradition case heard by the Manila Regional Trial Court (RTC) Branch 32. No bail was recommended. According to lawyer Claro de Castro Jr., chief of the NBI Interpol Division, Guban is wanted to face criminal charges in the Justice of the Peace, New South Wales (NSW), Australia for violating the Crimes Act 1900 such as four counts of sexual intercourse with the victim when she was about 10 and 16 years old, one count of aggravated indecent assault on a child under 10 years old and one count of aggravated indecent assault on a child under 16 years old. Reports added the victim is the cousin of Guban who lived with the victim’s family in Oakhurst, New South Wales, Australia from November 1997 to May 19, 1998. On May 17, 1998, Guban had sexual intercourse with the victim at the victim’s house in New South Wales while the family was celebrating a birthday of a family member. The incident was reported to police the following day. Guban was nabbed on May 20, 1998 by the New South Wales Police and during investigation he claimed he had sex with the girl because the victim wanted too. The sexual intercourse and aggravated indecent assault against the victim were committed several times and in different places on Aug. 10, 1993, Jan. 15, 1997, Jan. 30, 1997, Oct. 1, 1997, October 30, 1997 , Nov. 1, 1997, Nov. 30, 1997 and on Feb. 28, 1998 when the victim was 7, 10, 11 and 12 years old,. Meanwhile, the Children’s Hospital in NSW, Australia issued a report that the victim even contracted sexually transmitted disease (Chlamydia). On Nov. 28, 1998, respondent was conditionally bailed out to appear at Penrith Local Court and his passport was seized as condition to his bail. New South Wales also notified the Department of Immigration of the respondent’s arrest and advised DIMIA that respondent had illegally entered Australia under the name of Ariston Zabat. On Aug. 27, 1998, respondent was taken into custody by DIMIA using the name Ariston Zabat and subsequently deported to the Philippines on Oct. 28, 1998 without the knowledge of the New South Wales Police and he failed to attend court hearings. An extradition case was filed at the Manila court which ordered the NBI to arrest respondent.
